Terms of Service

1. Acceptance of Terms

Welcome to BiteMath. These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and BiteMath ("BiteMath," "we," "us," or "our") governing your access to and use of the BiteMath website at www.bitemath.ai, the BiteMath web application at bitemath.ai, and any related services, features, or content (collectively, the "Service").

By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.

You must be at least 13 years of age to use the Service. If you are between 13 and 18 years of age, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Account Registration

To use BiteMath, you must sign in using Google OAuth ("Sign in with Google"). By authenticating through Google, you authorize us to access certain information from your Google account, including your name, email address, and profile picture, as described in our Privacy Policy.

You are responsible for maintaining the security of your Google account credentials. You agree to notify us immediately at hello@bitemath.ai if you believe your account has been accessed without authorization. BiteMath is not liable for any loss or damage arising from unauthorized access to your account.

You may only create and maintain one account. You agree that the information associated with your Google account is accurate and that you will not impersonate any other person or entity.

3. Description of Service

BiteMath is a nutrition tracking application that allows users to describe meals in natural language and receive AI-generated estimates of macronutrient content (calories, protein, carbohydrates, and fat). The Service also provides personalized nutrition target calculations, daily tracking dashboards, weight logging, and historical analytics.

BiteMath is available as a Progressive Web App (PWA) accessible through modern web browsers on mobile and desktop devices.

4. Subscription and Billing

4.1 Free Trial

New users are eligible for a 7-day free trial of the Service. During the trial period, you will have full access to all features. At the end of the trial, your access will convert to a paid subscription unless you cancel before the trial expires. We will notify you before your trial ends and any charge is applied.

4.2 Subscription Plans

BiteMath offers two subscription options:

• Monthly: $5.00 per month, billed monthly
• Annual: $48.00 per year, billed annually (equivalent to $4.00 per month)

All prices are in United States Dollars (USD) and are inclusive of the subscription fee only. Applicable taxes may be added based on your jurisdiction.

4.3 Payment Processing

Payments on the web are processed through Stripe, Inc. Payments through native app stores are processed through RevenueCat and the respective app store payment system. By subscribing, you agree to the payment terms of the applicable payment processor. BiteMath does not store your full credit card number or payment credentials on its servers.

4.4 Automatic Renewal

Subscriptions automatically renew at the end of each billing cycle (monthly or annually) unless you cancel before the renewal date. The renewal charge will be applied to your payment method on file at the then-current subscription rate.

4.5 Cancellation

You may cancel your subscription at any time through your account settings within the app. Upon cancellation, you will retain access to the Service through the end of your current paid billing period. No further charges will be applied after cancellation takes effect.

4.6 Refunds

Because BiteMath offers a free trial period, subscription fees are generally non-refundable. However, if you believe you have been charged in error, please contact us at hello@bitemath.ai within 14 days of the charge, and we will review your request on a case-by-case basis. Refunds for subscriptions purchased through app stores are subject to the refund policies of the respective app store (Apple App Store or Google Play Store).

4.7 Price Changes

We reserve the right to change subscription pricing at any time. If we increase prices, we will provide at least 30 days' notice via email or in-app notification before the new pricing takes effect. Price changes will apply at the start of your next billing cycle following the notice period. If you do not agree to the new pricing, you may cancel your subscription before the price change takes effect.

5. Acceptable Use

You agree to use the Service only for its intended purpose of personal nutrition tracking. You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation
• Attempt to gain unauthorized access to any portion of the Service, other user accounts, or any systems or networks connected to the Service
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service
• Use automated scripts, bots, scrapers, or other automated means to access or interact with the Service
• Submit false, misleading, or malicious content through the natural language meal input or any other input mechanism
• Resell, sublicense, or commercially exploit the Service or any data obtained from the Service
• Interfere with or disrupt the integrity or performance of the Service or the data contained therein
• Circumvent or attempt to circumvent any usage limits, access controls, or subscription requirements
• Use the Service to provide nutritional advice, medical guidance, or similar professional services to third parties

We reserve the right to suspend or terminate your account if we determine, in our sole discretion, that you have violated these acceptable use requirements.

6. AI Disclaimer and Health Information

6.1 AI-Generated Estimates

BiteMath uses artificial intelligence (powered by Google Gemini) to estimate the macronutrient content of meals based on your natural language descriptions. These estimates are generated algorithmically and are approximations only. AI-generated nutritional estimates may be inaccurate, incomplete, or inconsistent. Actual nutritional values depend on specific ingredients, preparation methods, portion sizes, brands, and other variables that the AI may not fully account for.

6.2 Not Medical or Nutritional Advice

The Service is intended as a general wellness and personal tracking tool. BiteMath does not provide medical advice, nutritional counseling, dietary prescriptions, or any form of professional health guidance. The macro targets, calorie estimates, and other information provided by the Service should not be used as a substitute for advice from a qualified healthcare professional, registered dietitian, or nutritionist.

6.3 Assumption of Risk

You acknowledge and agree that you use the nutritional estimates and tracking features at your own risk. If you have dietary restrictions, food allergies, medical conditions (including but not limited to diabetes, eating disorders, kidney disease, or metabolic disorders), or are pregnant or nursing, you should consult a qualified healthcare professional before making dietary decisions based on information from the Service.

6.4 No Guarantee of Accuracy

We make no warranties or representations regarding the accuracy, completeness, or reliability of any AI-generated nutritional information. BiteMath is not responsible for any health consequences that may result from dietary decisions made based on the Service's estimates or recommendations.

7. Intellectual Property

7.1 Our Intellectual Property

The Service, including its design, features, functionality, source code, graphics, user interface, logos, and trademarks, is owned by BiteMath and is protected by copyright, trademark, and other intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial nutrition tracking purposes.

7.2 Your Content

You retain ownership of the data you submit to the Service, including meal descriptions, weight entries, and profile information ("User Content"). By using the Service, you grant BiteMath a limited license to process, store, and analyze your User Content solely for the purpose of providing and improving the Service. We will not sell your User Content to third parties.

7.3 Feedback

If you provide suggestions, ideas, or feedback about the Service ("Feedback"), you grant BiteMath a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate such Feedback into the Service without any obligation or compensation to you.

8. Privacy and Data

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in our Privacy Policy.

You may delete your account and all associated data at any time through the account settings in the app. Upon account deletion, we will permanently remove your personal data and User Content from our systems, subject to any legal retention obligations.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BITEMATH AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

• Your access to, use of, or inability to use the Service
• Any AI-generated nutritional estimates, macro calculations, or other information provided by the Service
• Any health outcomes, dietary decisions, or medical consequences related to your use of the Service
• Any unauthorized access to or alteration of your data or account
• Any third-party conduct or content on or through the Service
• Any interruption, suspension, or termination of the Service

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BITEMATH'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO BITEMATH IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) FIFTY UNITED STATES DOLLARS ($50.00).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, THE LIMITATIONS ABOVE SHALL APPLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. BITEMATH EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE FOREGOING, BITEMATH DOES NOT WARRANT THAT: (A) THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; (B) THE RESULTS OBTAINED FROM THE SERVICE, INCLUDING AI-GENERATED NUTRITIONAL ESTIMATES, WILL BE ACCURATE OR RELIABLE; (C) THE QUALITY OF THE SERVICE WILL MEET YOUR EXPECTATIONS; OR (D) ANY ERRORS IN THE SERVICE WILL BE CORRECTED.

11. Indemnification

You agree to indemnify, defend, and hold harmless BiteMath and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of or access to the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property or privacy right; or (d) any claim that your User Content caused damage to a third party.

12. Termination

12.1 Termination by You

You may terminate your account at any time by deleting your account through the app's account settings. Upon deletion, your subscription will be canceled, and all of your data will be permanently removed from our systems.

12.2 Termination by BiteMath

We may suspend or terminate your account and access to the Service at any time, with or without cause and with or without notice, if we reasonably believe that: (a) you have violated these Terms; (b) your use of the Service poses a security risk or may cause liability to us or others; or (c) your account has been inactive for an extended period. We may also terminate the Service entirely at our discretion upon reasonable notice to users.

12.3 Effect of Termination

Upon termination, your right to access and use the Service will immediately cease. Sections 6 (AI Disclaimer), 7 (Intellectual Property), 9 (Limitation of Liability), 10 (Disclaimer of Warranties), 11 (Indemnification), 13 (Governing Law), and 14 (Dispute Resolution) shall survive termination of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law provisions. Any legal action or proceeding relating to these Terms shall be brought exclusively in the state or federal courts located in the State of Delaware, and you consent to the personal jurisdiction of such courts.

14. Dispute Resolution

14.1 Informal Resolution

Before filing any formal legal action, you agree to first attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Service ("Dispute") informally by contacting us at hello@bitemath.ai. We will attempt to resolve the Dispute within 30 days of receiving your notice. If the Dispute is not resolved within 30 days, either party may proceed with formal dispute resolution.

14.2 Binding Arbitration

If informal resolution is unsuccessful, any Dispute shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall be conducted in the State of Delaware or, at your election, by telephone, online, or based on written submissions. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

14.3 Class Action Waiver

YOU AND BITEMATH AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. Unless both you and BiteMath agree otherwise, the arbitrator may not consolidate or join more than one person's claims and may not preside over any form of a representative or class proceeding.

14.4 Exceptions

Notwithstanding the above, either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights. Additionally, claims arising under consumer protection statutes that prohibit pre-dispute arbitration agreements are excluded from the arbitration requirement to the extent such prohibition applies.

15. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email (sent to the email address associated with your Google account) or by posting a prominent notice within the app at least 15 days before the changes take effect. The "Effective Date" at the top of this page will be updated to reflect the date of the most recent revision.

Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the modified Terms, you must stop using the Service and delete your account before the changes take effect.

16. General Provisions

16.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and BiteMath regarding the Service and supersede all prior agreements and understandings, whether written or oral.

16.2 Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

16.3 Waiver

The failure of BiteMath to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by BiteMath.

16.4 Assignment

You may not assign or transfer these Terms or your rights under these Terms without BiteMath's prior written consent. BiteMath may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of all or substantially all of its assets.

16.5 Force Majeure

BiteMath shall not be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to natural disasters, acts of government, internet service disruptions, power outages, or third-party service failures.
